INCA EXPERIENCE, S.A. DE C.V.: TERMS AND CONDITIONS
Purchase of the Bamba Experience S.A de C.V Hop on Hop off Bus Pass
Upon purchase of the Bamba Experience S.A de C.V Hop-On Hop-Off Bus Pass, or any related adventure, activity or tour you are bound to the following terms and conditions:
1) VOUCHERS
Travel agent voucher numbers must be given to Bamba Experience S.A DE C.V before the holder is able to get on the Bamba Experience S.A DE C.V service. This can be either via email to flexibility@bambaexperience.com or over the phone, 01800-GO BAMBA toll free number.
2) DEPARTURE DATE
The first day of travel must be within 12 months of either agency voucher OR Bamba Experience S.A DE C.V. Confirmation number issue, whichever is the earliest date. Upon notification of the agency voucher to Bamba Experience S.A DE C.V, stating the first Date of Travel, the pass will then be valid (from the stated first Date of Travel) to 6 months after. For passes to Costa Rica, the duration is different, see below in Validity of Pass.
3) VALIDITY OF PASS
Bamba Experience S.A DE C.V travel passes, are issued for the specific route, and are valid for 6 months (from the stated first Date of Travel), enabling the client to travel through the route, based upon availability. The passes to Costa Rica are valid for 1 month (from the first day of travel).
4) RESERVATIONS
(a) Sector Travel reservations are required and should be made in advance to assure your seat on desired date of travel. Confirmation of these dates is required at least 2 days before departure and the traveller/costumer must specify in the Hostel to Hostel Routes in what accommodation he/she would like to be picked up or comply to show up at any of the pickup points.
(b) Changes to reserved travel dates must be made at least 24 hours to departure by contacting our reservations department either through:

5) DISCOUNTS AND MONEY REFUND
There will be no discounts or money refunded for missed or unused services, this includes voluntary or involuntary termination, i.e. sickness, death of a family member, etc.
6) CANCELLATIONS
A cancellation fee of $100 for travel agent’s vouchers and related bookings.
Cancellation Policy applies when:
(a) The confirmation number is issued.
(b) Confirmation numbers which have passed the 12 month expiry (as per condition #1 of these Terms and Conditions) and against which, the first Date of Travel has not taken place.
7) CANCELLATION BY THE CLIENT
Any cancellation by a Client must be made in writing and acknowledged by Bamba Experience S.A. DE C.V. The date on which the letter is received by Bamba Experience S.A. DE C.V. or its Agents will determine the cancellation charge applicable.
(a) Cancellation for Bamba Experience S.A. DE C.V.
The cancellation charges are expressed hereafter as a percentage of the total tour price, excluding insurance.
A. Cancellation more than 30 days before departure: Loss of deposit.
B. Cancellation 29-15 days before departure: 50% of tour price.
C. Cancellation less than 15 days before departure: 100% of tour price.
8) NO SHOWS MEXICO
Should a passenger fail to show for a booked and confirmed sector departure from any point the passenger’s pass will become null and void. A $35.00 penalty will be payable to re-validate the pass for continued travel.
9) PASSENGERS, LUGGAGE, OR GOODS
Bamba Experience S.A DE C.V is not a common carrier and reserves the right to refuse to agree to carry any passenger, luggage or goods without giving any reason.
10) FLEXIBILITY
Bamba Experience S.A DE C.V may alter its timetable(s), inclusive of those impacted by other Operators’ products and relating to all services provided for in this ticket without notice. The Client appreciates and acknowledges that the nature of this type of travel requires considerable flexibility and should allow for alternatives. The itinerary provided for each trip is merely representative of the types of activities contemplated, and Bamba Experience S.A. DE C.V. is under no contractual obligation to strictly follow it. It is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events, which may include sickness or mechanical breakdown, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, high season, climate and other unpredictable or unforeseeable circumstances.
11) CHANGES
Changes made by Bamba Experience S.A. DE C.V.: Bamba Experience S.A. DE C.V. reserves the right to change any of the facilities, services or prices described in the brochure before a booking is made. If such a change is made, the Client will be told at the time of booking or when the change occurs. While Bamba Experience S.A. DE C.V. will endeavour to operate all trips as advertised, reasonable changes in the itinerary may be made where deemed necessary or advisable by Bamba Experience S.A. DE C.V. If Bamba Experience S.A. DE C.V. makes a major change Bamba Experience S.A. DE C.V. will inform the Client as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. If the major change is due to force majeure or unforeseen circumstances no compensation is payable. When a major change is made Bamba Experience S.A. DE C.V. may choose between accepting the change, obtaining a full refund of all the money paid or accepting any alternative trip offered by Bamba Experience S.A. DE C.V.
12) BAMBA EXPERIENCE S.A DE C.V. RESPONSABILITIES
Bamba Experience S.A DE C.V shall not be liable for any loss (financial or otherwise), or damage incurred, arising out of or consequential to (directly or indirectly), an abandonment of/delay to, departure or delay during any trip howsoever caused. Bamba Experience S.A DE C.V will not be liable for the sickness of or any other injury to any passenger or for the loss of or damage to any personal effects, luggage or other goods, whether caused by Bamba Experience S.A DE C.V.’s negligence or otherwise, and the purchaser of this ticket and passenger jointly and severally agree to indemnify Bamba Experience S.A DE C.V against any liability to any person on whose behalf such travel was booked or such pass was purchased.
13) ILLEGAL SUBSTANCES
Bamba Experience S.A DE C.V does not allow customers to carry any type of illegal drug in the bus. If the federal police stops the bus and finds illegal drugs in a passenger’s bag or on him/her, Bamba Experience S.A DE C.V will not be liable for that cause, and the customer will be liable and assume full responsibility for carrying illegal drugs.
14) TRAVEL DOCUMENTS
(a) The Client must be in possession of a valid passport required for entry, departure and travel through each destination point along the itinerary of the tour, (your passport must be valid 6 months past your return date), all visas, permits and certificates including vaccination certificates, insurance policies are required for the whole of the journey. The Client accepts full responsibility for obtaining all such documents and permits, and is solely responsible for any adverse consequences resulting from missing or defective documentation. Any information or advice given by Bamba Experience S.A DE C.V regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, provided as a courtesy to the Client, and Bamba Experience S.A DE C.V is not responsible for any errors or omissions as to the information provided.
(b) To expedite the issuing of Bamba Experience S.A DE C.V travel documents please note that all tour related travel documents such as vouchers, itineraries and invoices will be sent via email or will be available on our website once full payment has been received by Bamba Experience S.A DE C.V. Bamba Experience S.A DE C.V reserves the right to impose a fee for those Clients who wish to receive paper documents.
15) INSURANCE
It is recommended by Bamba Experience S.A DE C.V that all Clients mandatory obtain travel insurance with a minimum coverage of US$75,000 while travelling with Bamba Experience S.A DE C.V. When the Client has obtained travel insurance through Bamba Experience S.A DE C.V, the Client acknowledges that he/she is satisfied with the levels of insurance arranged by Bamba Experience S.A DE C.V.
16) CLAIMS AND COMPLAINTS
If a Client has a complaint against Bamba Experience S.A DE C.V the Client must first inform the driver or company representative whilst on the tour in order that the driver/representative can attempt to rectify the matter. If satisfaction is still not reached through these means then any further complaint must be put in writing to Bamba Experience S.A DE C.V within 30 days of the end of the trip. Bamba Experience S.A DE C.V will not accept any liability for claims received after this period.
17) LOCAL CONDITIONS
Client acknowledges that she/he will be visiting places where the political, cultural and geographical attributes present certain risks, dangers and physical challenges greater than those present in our daily lives. By booking travel with Bamba Experience S.A DE C.V, Client acknowledges that he/she has considered the potential risks, dangers and challenges, and expressly assumes the risks attendant to such travel conditions. Client is solely responsible for acquainting him/herself with the customs, weather conditions, physical challenges and laws in effect at each stop along the itinerary, and is encouraged to locate or make contact prior to embarkation with his/her local embassy or consulate in each destination.
18) INCREASE OF STANDARD CHARGES
In the event of any increase(s) in Bamba Experience S.A DE C.V’ standard charges, as identified in this promotional material and which therefore replaces the charge accepted by the customer, as described in this promotional material, the purchaser of the pass shall be liable for the additional charges.
19) SEVERABILITY
In the event that any term or condition contained herein is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this Agreement or amended accordingly only to such extent necessary to allow all remaining Terms and Conditions to survive and continue as binding.
20) UNDER AGE PASSENGERS
Passengers under the age of 16 years must be accompanied by their parents, legal guardians or adult chaperone.
21) SUCCESSORS AND ASSIGNS
These Terms and Conditions shall inure to the benefit of and be binding upon Bamba Experience S.A. DE C.V. and the Client and their respective heirs, legal personal representatives, successors and assigns.
22) ERRORS AND OMISSIONS
Although Bamba Experience S.A. DE C.V. has made a concerted attempt to verify the accuracy of statements made herein and Bamba Experience S.A. DE C.V. cannot be held responsible for any error, omission or unintentional misrepresentation that may appear in this brochure and on the website.
23) PRIVACY POLICY
Bamba Experience S.A. DE C.V. will provide your personal information, as well as any personal information you provide in relation to the persons whose travel arrangements have been requested by you, to suppliers and carriers to enable the operation of the services requested by you. We do our utmost to protect your personal information.
24) TERM BAMBA EXPERIENCE S.A. DE C.V.
In this agreement the term �Bamba Experience S.A DE C.V� includes Bamba Experience S.A DE C.V, its servants, agents and subcontractors.
The objective of travelling with Bamba Experience S.A DE C.V is to try with our best effort to bring you into peace of mind and enable you to learn about yourself and the world around you; through our impeccable services and service quality.
25) RESPONSIBILITY FOR YOUR ADVENTURE
All services herein are organized by Bamba Experience S.A. DE C.V. Notice is hereby given that all arrangements made on behalf of customers are made by organizers on the sole condition that the organizers shall not be held responsible for any injury, death, accident, delay, loss, damage or irregularity which may be occasioned through acts of any company and/or persons engaged in carrying out the arrangements. Bamba Experience S.A. DE C.V. acts as an agent for transport companies, hotels and other contractors and shall not be held liable for any injury, damage, loss, delay, or irregularity that may occur, including, but not limited to, any defect in a vehicle or any other form of conveying a traveller, natural disasters/catastrophes, detention, negligence of behalf of the supplier, delays or expenses arising from quarantine, strike, riots, theft, force majeure, civil disturbance, government restriction or regulation, accident by aircraft, boat, bicycle, motor vehicle or any other form of transport or in any hotel or guest house, pension, or other form of accommodation. The client acknowledges that the quality of the products organized by Bamba Experience S.A. DE C.V., including transportation, accommodations and all other services related to the adventure which are organized by Bamba Experience S.A. DE C.V., are not within the control of Bamba Experience S.A. DE C.V. and that in any event the quality of such products may be compromised by local conditions.
Accordingly, the client hereby releases Bamba Experience S.A. DE C.V. from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to the quality of such products. The information contained in this brochure is correct to the best of Bamba Experience S.A. DE C.V’s knowledge and Bamba Experience S.A. DE C.V. accepts no liability for any innocent inaccuracies contained herein. Bamba Experience S.A. DE C.V. reserves the right to alter any itinerary in progress or service at any time without penalty to Bamba Experience S.A. DE C.V. Any additional expense or cancellation shall be borne by the customer. The organizer reserves the right to withdraw or refuse any service to any customer at the discretion of the organizer. Payment of deposit is taken as acknowledgement and agreement of the above items.
